Guild 1947 is operated by JKS Retail (trading as Guild 1947), with a registered address at 5th Floor, Wing A, Flat No. 502, Kasturi Pride, Parnkutir Society Main Road, Atithi Chowk, Rajkot, Gujarat – 360001, India. (For Indian law purposes, JKS Retail is the body corporate responsible for this Privacy Policy under the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011. Once the Digital Personal Data Protection Act, 2023, is fully operational for this processing, JKS Retail will act as the Data Fiduciary for personal data processed for the purposes determined by it. Shopify, payment gateways, courier/logistics partners, email/SMS providers, analytics providers and other service providers may process personal information on our behalf as service providers/data processors or, in limited cases, independently under their own privacy notices.)

JKS Retail operates the Services (including all related information, content, features, tools, products and services) to provide you, the customer, with a curated shopping experience (the "Services"). Guild 1947 is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

Please read this Privacy Policy carefully. By using and accessing any of the Services, your personal information will be handled in accordance with this Privacy Policy. Where applicable law requires consent, including for sensitive personal data or information, marketing communications, cookies/non-essential trackers, or any processing not necessary for providing the Services, we will seek your consent through an affirmative action. Mere browsing of the Services will not be treated as consent for processing that legally requires express consent.

We do not knowingly collect health, biometric, sexual orientation or medical history data through the Services. Personal information does not include information that is collected anonymously or that has been de-identified so that it cannot identify or be reasonably linked to you. Contact details including your name, address, billing address, shipping address, phone number, and email address.
Payment and transaction information, including transaction value, order ID, payment method, payment confirmation, refund status and limited payment details made available to us by Shopify or our payment gateway. Unless expressly stated at checkout, Guild 1947 does not itself store full card numbers, CVV, UPI PINs, net-banking credentials or full bank-account credentials. Payment credentials are processed by Shopify and/or the relevant payment gateway under their security and privacy terms.
Account information, including your username, password, security questions, preferences and settings.
Browsing and order history, including the items you view, put in your cart, add to your wishlist, or purchase, return, exchange or cancel, and your past transactions.
Communications with us, including the information you include in communications with us, for example, when sending a customer support inquiry.
Device information, including information about your device, browser, or network connection, your IP address, and other unique identifiers.
Usage information, including information regarding your interaction with the Services, including how and when you interact with or navigate the Services.

We will not publish sensitive personal data or information. We will disclose sensitive personal data or information to third parties only with your prior permission, where such disclosure is necessary for performance of our lawful contract with you, where permitted under this Privacy Policy/our Terms, or where required for compliance with a legal obligation, court order, government request or applicable law. Third parties receiving such information must not disclose it further except as permitted by law or contract.

Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you.

In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. For certain Shopify-provided features, Shopify may process personal information independently or jointly for Shopify-determined purposes. This does not remove Guild 1947's responsibility for personal information processed for the Store's own purposes. Children's Data

International Transfers

Your personal information may be stored or processed in India and in other countries where Shopify, payment gateways, cloud providers, email/SMS providers, analytics providers, courier/logistics partners or other service providers operate. Where sensitive personal data or information is transferred, we will take reasonable steps to ensure that the recipient provides at least the same level of data protection as required under applicable Indian law and that the transfer is necessary for the performance of our contract with you, based on your consent, or otherwise permitted by law. Once the DPDPA cross-border transfer framework is fully operational, we will comply with any applicable restrictions notified by the Central Government.
